Terms of use
These are the terms between you and Boujolie. They are written to be read, not to be scrolled past.
What Boujolie is
Boujolie is a place where people post their hair and tag the products they used, say which products worked for them, talk under a post, and buy what is tagged in one. A brand’s page is its catalog. People here say what worked on their own hair, in their own words, and can say what their hair is like so people with hair like theirs can find them.
Boujolie itself never tells you what to use. Nothing anyone posts is a promise from us that a product will work on your hair.
While Boujolie is in beta, accounts are opened from a waitlist and a brand’s world is opened by us. Nothing about an application is scored; it is a queue.
What Boujolie is for
Boujolie is about hair: textured hair first, every hair type welcome, and the beauty that goes with it. A post about what you did with your hair and what you used belongs here.
Food, drink, clothing, furniture and home goods are not what this place is for, and nothing here may say a product grows hair or treats, cures or changes your body or your health. A world that sells outside hair and beauty is not opened. A post that is not about hair is not promoted, and it can be taken down.
Price
Joining is free. When you buy something, you pay the brand’s stated price for the thing you buy, and nothing more to us.
A brand pays nothing to open a world, keep a catalog or be tagged here. When an order comes through Boujolie, a share of it is our fee, stated with the brand when its world opens for sales and held until the brand’s own returns window closes. A brand may pay to put one of its posts in front of more people; a post pushed that way says Sponsored on its face, and the brand is charged for the people it reached, up to the ceiling it set, never more.
Buying things
Orders are placed with the brand that makes the piece, at its stated price, under its stated shipping and returns terms, which are shown before you pay. The brand fulfils the order from its own store; we show you where it is.
Payment is handled by the brand’s store and its payment processor. We never hold your card details.
Returns and refunds
Boujolie does not sell anything and does not take anything back. Every order is a sale by the brand, under the brand’s own returns and refund terms, which stand on the piece before you pay. A return, an exchange, a refund, a parcel that did not arrive or a piece that arrived wrong is settled with the brand, and the brand is responsible for settling it.
We never hold your money, so we cannot refund it. If a brand does not answer you, write to us and we will take it up with them.
Earning
Some members earn when a piece they tagged leads to a sale. Every figure comes from the rate set with the brand when its world opens, holds through the brand’s returns window, and a refunded order earns nothing. Each piece in an order is paid to the person whose post it came through, so one order can pay two people, each for their own pieces. A piece found in a brand’s catalog after a tag brought you there counts for the person who tagged it.
A post that tags a piece its author earns on says so on the post. That disclosure is not optional, here or in law. A post can also tag a product by its author’s own link, to a store or a network we are not part of; when they earn from that link they say so on the post, the sale happens on that site, and the brand or the network pays them on its own terms. We do not record, stamp or pay those sales.
To be paid you add your bank once through Stripe, who run the checks and hold the details; we never see your account. Earnings go out one day a week, once they reach $25 and once the brand has paid us for them, and anything under that gathers until it does. We say sent when the payment leaves us; it reaches your bank on Stripe’s own schedule after that. If a sale is refunded after you have been paid, we do not take it back from you.
For brands
A brand runs its world through the Studio. Connecting a Shopify store lets Boujolie read the store’s catalog, orders and tracking, and place an order in it when somebody buys through a tagged post. We never read the store’s customer records, and a buyer is named to the brand only when they bought here signed in.
Our share of a sale, and what a campaign reached, are added to the store’s own bill or charged to a card the brand saved with us. A campaign is billed each morning for the day before; stopping it means paying only for the days it ran. A refund on a sale we were paid on is credited against the brand’s next charges.
A brand’s page is its catalog. A brand does not post looks; the looks that tag its pieces are the people’s own, and a brand never rewrites or removes a person’s words.
A store can take its data back. When a store uninstalls Boujolie, or one of its shoppers asks to be erased, we act on it: the store’s key is deleted, its catalog is deleted, the order numbers and delivery details it published are cleared, and the shopper’s name and their link to a Boujolie account are cleared from the orders they asked about. Sales totals stay as a financial record, because we are required to keep one and because a creator has been paid out of it. A store can also ask us what we hold about one of its shoppers, and we answer to the store, which answers its customer.
Your posts
What you post is yours. By posting it here you give us permission to show it in the product, which is the whole point of posting it. You can delete it whenever you like.
Post about the pieces and the brands honestly. People are protected: no bullying, no harassment, one verified person per account.
A page belongs to whoever it is. Anyone can delete a comment left under their own post, and a brand can delete one left in its own world, so a comment you leave can be taken down. What you wrote is never edited, and nothing is ever posted in your name.
Copyright
Post only what is yours to post: your own photographs and videos, or ones you have permission to use. A brand is responsible for its own catalog, its pictures, its descriptions and every claim it makes about a piece.
If something on Boujolie is yours and you did not allow it, write to remeurme@gmail.com with a link to it and we take it down. An account that keeps posting what is not theirs is closed.
Showing your posts outside the app
A post you made public may stand in a preview of Boujolie: the front page, a listing in an app store, a picture of the app. Your username stays on it. Deleting the post ends that, and so does one email to us asking us to stop.
We never sell your pictures, and we never hand them to a brand for its own advertising. A brand that wants to use your post asks you.
Acceptable use
Use Boujolie as yourself, for yourself. Do not try to break into other accounts, scrape the service, resell it, game the ratings or the earning system, or use it for anything unlawful. We can suspend accounts that do. A post may not say a product grows hair or treats a condition: say what you saw on your own hair. A post that makes such a claim is refused when it is written, and one that slips through is taken down.
What we promise, and what we cannot
We work to keep the service up and the record honest. But software has bugs and brands are their own businesses, so Boujolie is provided as is, and we cannot promise it will always be complete, current, or uninterrupted. To the extent the law allows, our total liability is limited to what you paid us in the past twelve months.
Ending things
You can stop using Boujolie whenever you want and ask us to delete your account and its data; it closes 90 days later and you can keep it until then. A sale made here keeps the names on it as a sales record. We can close accounts that break these terms.
If something goes wrong between us
Write to us first and we will try to fix it like people. The formal dispute terms will be settled with counsel before launch, and they will be printed here before anyone is asked to agree to them.
